Nova Phase5 "Nova" is licensed software provided by AWareNova.ca. By purchasing, activating, or using Nova, you agree to these Terms & Conditions. If you do not agree, do not purchase or use the software.
These Terms describe how your license works, what you may and may not do with Nova, and the limits of our responsibilities. Please read them carefully.
01 License Grant
Nova is licensed to you, not sold. You are granted a license to use the software, and AWareNova retains all ownership of Nova.
Your license is:
- Non-exclusive — the same software is licensed to other customers.
- Non-transferable — it may not be given, sold, or reassigned to anyone else.
- Revocable — it may be suspended or revoked as described in these Terms.
- Limited to the duration and number of devices included with your purchased plan.
02 License Duration
The plan you purchase determines how long your license remains active and how many devices it may be used on at once. When your license period ends, access to Nova ends unless the license is renewed.
Every license automatically includes a small grace period after the purchased duration to allow for setup, installation, and first-time activation.
03 Acceptable Use
Your license is for your own use. You may not:
- Share your license with others.
- Resell your license.
- Sublicense the software.
- Distribute the software or your license key.
- Bypass, disable, or interfere with licensing or activation.
- Abuse, overload, or interfere with the service.
- Automate or attempt to automate license generation.
- Impersonate another customer or use another customer's details.
04 Reverse Engineering
To protect the integrity of Nova, you may not:
- Reverse engineer the software.
- Decompile or disassemble the software.
- Modify or create derivative versions of the software.
- Patch, crack, or otherwise alter the software.
- Bypass or defeat any protection or licensing mechanism.
- Extract, copy, or reuse internal code or assets.
05 Updates
Nova may receive updates, fixes, and improvements at any time. Features may be added, changed, or removed without prior notice as the software evolves.
06 Availability & No Guarantee
Nova depends on third-party services and websites that are outside our control and may change at any time. Nova Phase5 is provided on an "AS IS" and "AS AVAILABLE" basis.
We make no guarantee regarding:
- Uninterrupted or error-free service.
- Compatibility with any particular system or setup.
- Speed or performance.
- Future functionality or continued availability of features.
- Obtaining, securing, or being matched to any shift.
- Any specific result or outcome.
07 User Responsibilities
You are responsible for:
- Securing your own computer and account.
- Keeping your license key confidential.
- Complying with all applicable laws.
- Complying with the Terms of Service of any third-party website or platform you use Nova with.
08 Refund Policy
Refund requests submitted before a license has been issued may be considered at the Creator's sole discretion.
Once a license has been generated and delivered, all sales are final.
09 Suspension / Termination
Licenses may be suspended or revoked if abuse, fraud, or violations of these Terms are detected. Where a license is revoked for such reasons, no refund is owed.
10 Limitation of Liability
To the maximum extent permitted by law, Nova and AWareNova shall not be liable for:
- Indirect, incidental, or consequential damages.
- Lost profits.
- Lost opportunities.
- Downtime or interruptions.
- Changes made by third-party websites or services.
- Account actions taken by third parties.
11 Privacy
Licensing information is collected only for activation, verification, and support. For full details on what we collect and how it is used, see our Privacy Policy.
12 Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable laws of Canada.
13 Entire Agreement
These Terms constitute the complete and entire agreement between you and AWareNova regarding the use of Nova, and supersede any prior understandings on that subject.
